Website Terms of Use

Our terms of use are written to protect you and us. You should read through these terms carefully before using the Website. You agree to follow them and not interfere with our property or other users. The following points are important to understand if you want to use this website

You may not attempt to gain unauthorized access to any part of the Website, including but not limited to, our connection ports, servers, or network.

You agree not to interfere with or disrupt the Website or servers and networks that host the Website or cause any nuisance to other users. You may not use data mining, robots, screen scraping or similar tools on the Website except with our prior written consent.

You agree not to interfere with or disable the security-related features of the website, or any part of its content.

You agree not to use, copy, distribute or commercially exploit content found on this website without the prior written consent as permitted by this agreement, by law or with our prior written consent.

You understand and agree that clickandtrip.com.au may report any suspected fraudulent, abusive, or illegal activity to law enforcement authorities.

We may cancel your registration at any time, for any reason and without prior notice, at our sole discretion. If you have already purchased a package, we will email you a copy of any confirmation before cancelling registration.

Agency meaning

We exercise care in the selection of reputable travel service providers, but we are not a provider of travel services and have no control over, or liability for, the services provided by third parties. All bookings are made on your behalf subject to the terms and conditions imposed by these travel service providers. Your legal rights in connection with the provision of travel services are against the specific travel service provider and are not against us. Specifically, if for any reason (excluding fault on our part) any travel service provider is unable to provide the services for which you have contracted, your rights are against that provider and not against us.

User Agreement

This User Agreement is a legal agreement between you, the user of the Website and Click and Trip for use of the Website. The terms and conditions of this Agreement are subject to change at any time at our discretion, provided that such changes do not substantially affect your rights and obligations. If such changes substantially affect your rights and obligations we will notify you by email of these changes as they occur.

Registration

To access or purchase items on the Website (clickandtrip.com.au), you must be a registered member of the Website. When registering to become a member, you must provide your Personal Information (as this term is defined in the Privacy Act 1988 including a valid email address. You agree to provide accurate and complete information and always keep this information current. Your information is stored securely and will only be used and disclosed in accordance with our Privacy Policy. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. If you suspect or become aware of any unauthorised use of your account, you should notify us immediately (contact@clickandtrip.com.au ) and address your email to Account Access. By purchasing through the Website, you warrant that you are at least 18 years of age and have the legal right and ability to enter into a binding agreement with us. No persons under the age of 18 are permitted to use the Website or sign up as members.

Exclusions and Inclusions

A detailed list of inclusions and exclusions for each trip is available on the individual trip page. Flights (except where expressly stated), passport and visa fees, insurance, laundry, phone calls, beverages, meals not detailed in the itinerary, tips to trip directors, drivers and local city guides, items of a personal nature and expenses incurred due to flight delays are not included in any Click and Trip package. Click and Trip is not liable for any expense, costs or loss incurred in relation to such matters. You agree not to hold Click and Trip responsible for any such things.

Health

Vaccination requirements may be mandatory for entry into certain destinations. It is recommended that you check with your doctor about any requirements and recommended precautions for your destination before booking your trip. Failure to present the required vaccination documentation may prevent you from entering a country. We recommend that you consult with your local doctor, travel medical service or specialist vaccination clinic directly or via ‘My Account’ before commencing your travel. General health advice for the destination you wish to visit is also available from https://www.smartraveller.gov.au. Most countries require travellers to be double vaccinated by COVID-19 doses.

Please note that while we will do our best to include all medical requests as a file note to the travel service provider, we cannot guarantee that your request will be accommodated. It is your responsibility to follow up with the travel service provider directly either at the destination or prior to travelling where possible.

Financial Arrangements

We receive remuneration through cost-plus pricing and other financial arrangements from travel service providers that we recommend to you. We are not required by law to disclose the nature or value of these financial arrangements.

Taxes

Airline taxes may change and are subject to confirmation at the time your airline ticket is issued. In addition, some airports charge a local tax.

Service guarantees

If you purchase a booking from us and redeem a voucher for an offer from the relevant supplier, you will be purchasing a package from that supplier. The supplier (not Click and Trip) is responsible for honouring the product or service. Click and Trip promises to deliver its booking and advisory services with due care and skill, and we will always try to ensure that we only promote suppliers who will provide good service to you, however, we make no guarantee, warranty, or representation regarding the standard of any product or service to be provided by the supplier. You should expect that our services will achieve the desired result within a reasonable time frame. If we fail to meet these guarantees, you have rights under the Australian Consumer Law (ACL).

Product Descriptions

Our website features descriptions of accommodations and services that are based on information provided by hotels and other suppliers. The facilities presented as included in each property are subject to change at any time, and the standard of the property is based on various factors that we believe are indicative of a certain class. Click and Trip does not guarantee the standard, class or fitness for purpose of any accommodation or service and makes recommendations of classes suited to Comfort, Deluxe and Indulgence packages. Maps, photographs and other images in this guide are representative only. They may not necessarily reflect the exact locations, amenities or attractions you will find in the holiday. If a property that is listed on our website or in your confirmed travel book is unavailable, we will provide you with one of a similar style and star rating in the same location (please see product substitution).

Airlines publish baggage restrictions for their own services. These restrictions typically include cabin baggage and checked baggage. Both tend to be based on weight allowances or piece systems. It’s important to check your baggage allowances carefully, as you may incur a charge for the carriage of baggage over your free allowance.

Product Substitution  

Unfortunately, some services can become unavailable and need to be substituted with another service. Various examples can include engineering issues, insufficient numbers, stop sell etc. If you have not been provided with the product described and being able to provide this product or service is out of Click and Trip’s control, we endeavour to substitute a similar style, rated and located product or service.

Click and Trip Emergency Care Team

We provide emergency assistance to our customers via a dedicated WhatsApp number. If you need to cancel, change, or make changes to your trip before or after it begins, we will help you do so quickly and efficiently via the ‘Amendments’ button or online chat through ‘My Account’. When you book with us, please provide us with a telephone number where we can reach you at least 24 hours prior to your departure.

Liability

One of our key priorities is the safety of our customers. We will do everything we can to ensure your trip is safe, comfortable, and fun. However, if you are injured or have an accident while using our Services, you must take all reasonable care for your own safety and that of others. The liability of Click and Trip is limited to the extent permitted by law. Any loss or damage to baggage, personal items, damage, or loss to any items due to fire, theft, accident, or negligence of any persons or otherwise in connection with your trip is not the responsibility of Click and Trip. In circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required by law. The clause is subject to your rights under the Australian Consumer Law, and nothing in these Booking Terms and Conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth).

Links to Third Party Websites

Our website or access through ‘My Account’ may contain links to other websites, content or resources. These linked websites, content or resources are not under our control and we are not responsible for their content.

Frequent Flyer or Other Loyalty Program

Please ensure that your frequent flyer membership details, or any other applicable loyalty program details, are included in the space provided for inclusion in your booking. Please check with the supplier of your frequent flyer or other loyalty programs for the specific terms of your membership. We cannot guarantee that the supplier will credit you with points for your booking or provide you with any other benefits, including (without limitation) status credits or lounge access. The responsibility to check whether a booking is eligible for any such benefits rests solely with you. Please note that we do not handle frequent flyer bookings or airline requests on behalf of the traveller.

Monies Not Held on Trust

You agree and acknowledge that the money you pay to us will be used to pay for services from our travel partners. Before any services are provided, we will transfer money from our account to that of the travel service provider. In some cases, payment will be made to the travel service provider once services have been provided; however, in most instances, payment is made before services are provided. For flights booked through IATA airlines, monies might be held on trust for those airlines according to their terms and conditions; however, if we are still holding your funds after attempting refund authorization from them, we cannot refund you until they agree.

Intellectual Property

We reserve all intellectual property rights, including but not limited to copyright in material and/or services provided by us. Nothing in the agreement gives you a right to use any of our marketing material, business names, trademarks, logos, domain names or other distinctive brand features. Other trademarks used on the Website that belong to third parties are used with their consent and remain the intellectual property of that party.

By corresponding with us, you are granting us an irrevocable, perpetual, non-exclusive license to use your content in any way we determine appropriate. This includes publishing testimonials on our website and developing ideas and suggestions for new products or services.

Newsletter Registration or Communication by Us

By registering for Click and Trip, you consent to us sending you administrative emails regarding your account activity and purchases. Additionally, we may send you promotional emails that include new product information and offers. You may unsubscribe from these emails at any time by clicking the unsubscribe button at the bottom of our emails.

Modifications of these Booking Terms and Conditions

We reserve the right to amend any of these Booking Terms and Conditions at any time without prior notice. We will notify you of any changes to our booking conditions by posting changes on our website or in our applications or services. The applicable terms that apply are those in effect when you make a booking with us.

Passports & Visas

All travellers must have a valid passport for international travel, which must be valid for the duration of the trip as well as any required visa and re-entry permits. It is your responsibility to make sure that your passport, visa, and re-entry permits meet the requirements of immigration and other government authorities as some countries require at least 6 months of validity from the date of return. Click and Trip is not responsible for any fines, penalties, payments, or expenditures you incur as a result of your documents failing to meet the requirements of immigration and other government authorities. Any such fines, penalties, payments or expenditures are your sole responsibility. Click and Trip is not a Visa agency so cannot provide accurate information about this, however, we can also provide general advice and point you in the right direction to obtain further information.

Travel Documents

For each holiday booked with us, we will provide all the necessary travel documents and your travel booking confirmation will be accessible via your account with us. Digital travel booklets will be accessible from the ‘My Account’ section of our website, and you agree that we are not liable for any loss suffered as a result of you being unable to download, print or access a booking confirmation. Each holiday booking comes with its own set of terms and conditions. Please make sure you have read these carefully before making a booking with us. Terms and conditions related to each booking are also stated in the travel booklet and inclusive of the holiday’s restrictions including (without limitation) being non-refundable, non-date-changeable, and/or subject to cancellation and/or other change fees. The name on your passport, visa and other travel documents must all be identical. If they are not, your travel may be refused or your flights may be cancelled. An incorrect name on a booking may result in an inability to use that booking, the booking being cancelled and the application of additional change and/or cancellation fees. Please review your travel documentation carefully and advise us immediately of any errors in names, dates or timings. It is your responsibility to ensure you read the conditions on air ticket(s) and any baggage limits. We will not be liable for any expenses, fees, penalties, costs, liabilities, damages or losses associated with baggage allowances and excess baggage.

Travel Insurance

Travel insurance is strongly recommended by the Department of Foreign Affairs and Trade for all overseas travel and Click and Trip supports this. You should immediately after purchasing any travel product arrange your own insurance and our website provides you with information on the types of policies available, how to buy and where to go for further advice. Your travel insurance should at least include cover for cancellation, medical and repatriation expenses, personal injury and accident, death and loss of personal baggage and money as well as personal liability insurance. The insurance coverage offered by credit card companies or reciprocal medical cover agreements is often not comprehensive. Click and Trip makes no representations or guarantees concerning your ability to claim reimbursement for any funds paid by you under an insurance policy. You agree not to hold Click and Trip responsible for any decision made by insurers or suppliers, or requirements of any overseas country, government authority or laws and policies.

Prices

All prices shown are per person based on double occupancy inclusive of GST, are subject to availability and can be withdrawn or varied without notice. Price changes may occur by reason of matters outside our control which increase the cost of the product or service. Such factors include, but are not limited to, adverse currency fluctuations, fuel surcharges, taxes and airfare increases. Please continue to check our website for up-to-date pricing. Solo and child pricing supplements are shown on the total price only when selected.

Payment

Online bookings must be paid in full at the time of booking. Payments can be made through our secure website using a credit or debit card.

Payments by Credit Card and Debit Card

Click and Trip charges a 2.5% surcharge for all Visa and Master cards. American Express and international cards incur a 3% fee. Diners Club and Corporate/Premium Master or Visa Card incur a 2.5% fee. A 1.5% surcharge will apply when paying by Latitude Pay.

Under the Reserve Bank of Australia regulations on card surcharges, we (the merchant – Click and Trip) may only surcharge our average ‘cost of acceptance’. Our cost of acceptance charges is made up of our Payment Facilitator ZenPay Pty Ltd trading as TravelPay – ABN: 63 056 881 942 fees and one-off online payments processed by the merchant fee.

Travellers can also make payments via our PayID feature, which incurs a $1.00 (incl GST) fee per transaction. If paying by the PayID Payment Link, please ensure you fill in all fields and enter the correct Reference Number so that Click and Trip can identify your payment. PayID is not available on every trip and so you will need to contact Click and Trip about how to make payments via PayID.

If payment is not received from the card issuer or its agents for any reason, we reserve the right to invoice you directly, and you agree to pay us the full amount due immediately upon our request.

We do not accept cash, cheque or BPAY payments.

Change or Cancellation by the in-destination travel service provider

If your booking is cancelled by a travel service provider, the provider will generally offer you in the first instance alternative travel arrangements of comparable standard if available (and will refund any price difference if the alternative is of a lower value), or travel credit for the full amount paid by you. Alternatively, subject to the change or cancellation policy, the provider may offer you a refund of all money paid by you in respect of the booking, from which Click and Trip and/or our partners will deduct any direct and indirect costs we have incurred in relation to your booking, including non-refundable fees.

In the event of unavoidable or extraordinary circumstances, the travel service provider may modify or cancel your booking which could cause substantial inconvenience to you. These unavoidable or extraordinary circumstances cover any cause outside a travel service provider’s reasonable control which could not have been prevented or avoided even if all reasonable measures had been taken by the travel service provider, including but not limited to war, the threat of war, riot, civil disturbances, industrial dispute, terrorist activity and its consequences, plague, epidemic, pandemic, infectious disease outbreak or any other public health crisis (including quarantine or other employee restrictions), natural or other disasters (such as volcanic ash or hurricanes or similar events), nuclear incident, fire or bushfires, adverse weather conditions (actual or threatened), closed airports or ports or other modes of transport; changes to travel advisories and restrictions; changes to health advisories and quarantines; changes to immigration laws; labour laws; rescheduling of aircrafts/boats/other modes of transport etc

If your booking is cancelled due to unavoidable or extraordinary circumstances, either the travel service provider or Click and Trip may be eligible to offer you a travel credit.

Special Requirements

To ensure that your stay meets your specifications, we require you to notify us of any special requests at the time of booking. Should you require twin beds or a rollaway bed, please be sure to note this at the time of booking. If you have any dietary restrictions or medical conditions, be sure to notify us as soon as possible so that we can make appropriate accommodations during your stay. Some airlines may only allow pre-notification of special meal requirements. Please note that some hotels have a maximum capacity for particular rooms and suites.

Schedule Changes

Click and Trip Emergency Team will track your flight departure within 48 hours of your departure time. We still do recommend that you contact the airline to confirm your scheduled departure time 24 hours prior to your flight in case these changes were not passed along to our team.

Complaints

We try to ensure that the arrangements we make for you are implemented as agreed. Problems encountered should be resolved locally with the supplier (such as the hotel manager, in destination supplier or airline), but if you fail to follow this course, any claim for compensation may be reduced or denied.

If you have any unresolved complaint, details should be lodged in writing (with supporting documentation, including efforts made with the service provider to resolve it) directly to Click and Trip within 30 days of returning home to Australia.

We are not responsible for any loss or damage arising from the actions of any supplier, including negligent acts. If you wish to make a complaint in respect of a supplier, you must email that complaint to contact@clickandtrip.com.au

Any disputes arising from our relationship will be handled by the courts in the appropriate state, and you agree to waive your right to object to an action being brought in those courts.

Refunds will only be provided in accordance with our cancellation policy.

Modifications of these Booking Terms and Conditions

We reserve the right to amend any of these Booking Terms and Conditions at any time without prior notice. We will notify you of any changes to our booking conditions by posting changes on our website or in our applications or services. The applicable terms that apply are those in effect when you make a booking with us.

For general travel advice and information about specific destinations, we recommend you contact the Department of Foreign Affairs and Trade (“DFAT”) or visit their website at https://www.smartraveller.gov.au. You can also register your travel plans with DFAT, so that officials are aware of where you plan to go.

We advise you to become familiar with the status and updates to Australia’s immigration and border arrangements, available at https://covid19.homeaffairs.gov.au.

All travellers should familiarise themselves with airline requirements regarding passenger safety, including the requirement for wearing face masks and producing evidence of a negative COVID-19 test, both for transit and final destination passengers.

Please be aware of any relevant health risks before you travel; you are encouraged to review all travel information concerning the Coronavirus and other risks associated with travel. We accept no liability for your decision to travel at this time and thank you for taking responsibility for your own safety during your trip.

In accordance with Australian Consumer Law, fees for change and cancellation of your booking are payable by you and are not always levied by the in-destination provider. Trip cancellations may vary between each destination, so be sure to check individual trip cancellation policies on each trip page.

Airfare and itinerary changes will incur a fee of $100 per booking in addition to travel service provider fees.

These fees cover the reasonable, direct and indirect costs and processing time associated with managing changes to, or cancellations of your booking. You will also be responsible for any increase in pricing that may occur as a result of your change request.

If you need to change any aspect of your booking, please let us know immediately by logging into ‘My Account’ and selecting the ‘Amendments’ button, start a chat with one of our representatives or contact the dedicated WhatsApp emergency team number so we can work with you to find a solution. Any fees for such change or cancellation must be made via debit or credit card and will attract the applicable credit card surcharge.

For specials or non-refundable bookings, Click and Trip do not provide refunds for cancellations or changes.
